Terms and Conditions

Welcome to thebettercoffee.org. These Terms and Conditions (“Terms”) govern the use of the online store operated at thebettercoffee.org (the “Store”) and the conclusion and performance of agreements entered into through the Store. By accessing the Store or placing an Order, you agree to be bound by these Terms and the Privacy Policy. Please read them carefully before using the Store.
§1. General Provisions
1. Scope of the Terms and Conditions
1) These Terms and Conditions (“Terms”) set out the rules governing the use of the online store operated at the domain thebettercoffee.org (the “Store”) and the conditions for the conclusion and performance of sales agreements or service agreements offered through the Store (the “Agreements”).
2) The Terms apply exclusively to Agreements concluded through the Store (checkout).
3) The Terms do not govern the provision of free materials made available under licenses (including Creative Commons), unless such provision takes place through checkout; the rules governing the use of such materials result from the applicable license and the information provided with the respective material.
4) The Terms constitute an integral part of each Agreement concluded between the Client and the Seller.
5) The information required by applicable law prior to the conclusion of an Agreement, including the main characteristics of the performance, the total price, the conditions of performance, any limitations of the right of withdrawal, and technical requirements, is in each case presented in the Offer and forms part of the Agreement.
2. Seller
1) The Seller is Kbcoffee, Krzysztof Blinkiewicz, Tax Identification Number (NIP) 7743006883, Słowackiego 23/38, 09-400 Płock, Poland (the “Seller”).
2) The Better Coffee is the name of a project and a trade designation used within the Seller’s business activity and does not constitute a separate legal entity.
3) As of the date of publication of these Terms, the Seller is not a VAT payer in the Republic of Poland.
4) In matters concerning the performance of the Agreement, withdrawal from the Agreement, complaints, and the organization of services, the Client shall contact the Seller electronically at: office@thebettercoffee.org; email correspondence constitutes the primary communication channel for the purposes of performing the Agreement.
3. Scope of the Offer
1) The Store may offer, in particular:
a) digital content,
b) services, including educational and consulting services,
c) online courses and in-person courses,
d) licenses within the structures of The Trainers and The Places,
e) services or products related to The Ranking Method (TRM).
2) A detailed description of the performance, the conditions of performance, timelines, technical or organizational requirements, and any further stages of the process are specified in each case in the Offer and form part of the Agreement.
4. Definitions
1) Client – a natural person, a legal person, or an organizational unit with legal capacity that concludes an Agreement with the Seller.
2) Consumer – a natural person who performs a legal act not directly related to their business or professional activity.
3) Entrepreneur with consumer rights – a natural person who concludes an Agreement directly related to their business activity where, from the content of the Agreement, it follows that it does not have a professional character for that person.
4) Offer – a description of a product or service made available in the Store, including in particular the scope of performance, the price, conditions of performance, timelines, technical or organizational requirements, and information required by applicable law.
5) Digital Content – data produced and delivered in digital form.
6) Digital Content not supplied on a tangible medium – Digital Content supplied in a manner other than on a tangible medium, in particular by providing a download link or access link.
7) Service – any performance other than the supply of Digital Content.
8) Course – a Service performed at a specified time (online or in-person).
9) Electronic Service – a service provided by electronic means within the meaning of applicable law, including in particular the Store’s functionalities related to placing Orders and concluding Agreements.
10) Durable Medium – any material or tool that enables the Client to store information addressed to them in a way that allows access to that information in the future for a period adequate to the purposes for which the information is intended, and that allows the unchanged reproduction of the stored information.
11) License – an authorization to use specific designations, materials, or structures in accordance with the conditions described in the Offer and separate documents; the purchase of a License is not equivalent to the conclusion of a license agreement.
12) The Better Coffee Office – a support and coordination function within The Better Coffee Endeavour, performed by the Seller or an entity indicated in the system documents, responsible in particular for onboarding processes, license coordination, and the issuance of system documents (including the TRM Report), in accordance with the conditions described in the Offer and procedural documents.
13) Practice Review – a procedural stage related to the performance of TRM, including in particular the assessment of the completeness of materials and conditions necessary for the performance of TRM, in accordance with the rules specified in the Offer or procedural documents.
14) TRM – a performance related to The Ranking Method, in accordance with the description in the Offer.
15) Order – a declaration of intent by the Client aimed at concluding an Agreement.
16) Agreement – an agreement concluded through the Store.
17) Business Day – a day from Monday to Friday, excluding public holidays in Poland.
5. Meaning of “without undue delay”
Whenever these Terms use the expression “without undue delay,” it shall mean action taken without unnecessary delay.
6. Relationship between the Offer and the Terms
1) The Offer forms part of the Agreement.
2) In the event of any inconsistency between the Terms and the Offer, the Offer shall prevail with respect to the specific conditions of a given performance, unless mandatory provisions of law provide otherwise.
7. Territory and Language
1) The Store conducts sales without territorial limitations, subject to restrictions arising from applicable law, including regulations concerning sanctions and embargoes.
2) The Terms are drafted in English. Any other language versions, if made available, are provided for convenience only. In the event of discrepancies, the English version shall prevail, subject to mandatory provisions of law.
8. Availability of the Terms
1) The Terms are made available free of charge in the Store in a manner that enables their download, storage, and reproduction.
2) Use of the Store requires a device with internet access and an up-to-date web browser.
